Regarding Teachers Who Receive Dismissal or Suspension Final Decision Due to Campus Gender Related Incidents

Regarding teachers who receive dismissal or suspension final decision due to campus gender related incidents and who disagree with the handling result of the case schools are requested to clearly inform them of the remedy procedures for reconsideration and appeal in accordance with Article 37 and Article 39 of the Gender Equity Education Act hereinafter referred to as the Gender Equity Act. Please take note and inform all affiliated units.

Explanation:
1. Handled in accordance with the supplementary resolution of the 49th meeting of the 16th Central Teacher Appeal Review Committee of the Ministry.
2. When a teacher receives dismissal or suspension final decision due to a campus gender related incident and submits a reconsideration because they disagree with the school handling result the reconsideration decision is not an administrative disposition. If the teacher disagrees with the reconsideration review result according to the Ministry interpretation order dated October 29 2024 Tai Chiao Hsueh Three Tzu No 1132804741A the school or authority responsible for disciplinary action shall when notifying the reconsideration review result inform the teacher of the right to file a teacher appeal under Article 39 of the Gender Equity Act in order to prevent teachers from mistakenly filing an administrative appeal and exceeding the time limit for submitting a teacher appeal which could affect the protection of their remedy rights.
