Regarding Schools Reporting to the Competent Authority for Administrative Fines in Accordance with Article 43 of the Gender Equity Education Act hereinafter referred to as the Gender Equity Act Please Submit Relevant Supporting Documents as Explained Below

Explanation:
1. Article 43 of the Gender Equity Act clearly stipulates that violations of the provisions listed in the Act shall be subject to an administrative fine ranging from NT 10000 to NT 150000. The Ministry has revised and promulgated the "Procedures and Penalty Standards for Handling Violations of the Gender Equity Education Act by the Ministry of Education" hereinafter referred to as the Penalty Standards on November 22 2024.
2. The above penalties are subject to the provisions of the Administrative Penalty Act. When reporting cases to the Ministry for review and decision the following information shall be provided: (1) According to the format of the "Decision Document for Handling Violations of the Gender Equity Education Act by the Ministry" attached to the Penalty Standards provide the violator’s name gender date of birth and national identification number. If the person is no longer employed or enrolled at the school please also provide their mailing address and contact information to facilitate official document delivery by the Ministry. (2) The facts of the violation must be approved by resolution of the school Gender Equity Education Committee hereinafter referred to as the Gender Equity Committee therefore please provide the meeting minutes. According to Article 102 of the Administrative Procedure Act and Article 42 of the Administrative Penalty Act before making an administrative penalty decision the administrative authority must provide the party subject to the decision an opportunity to present opinions. Therefore schools do not need to request the violator to provide statements and the Ministry will notify the person in writing to present opinions. (3) Supporting evidence for the violation such as the investigation report of the school Gender Equity Committee official correspondence or communication records between the school and the violator and a chronological record of major events.
