Regarding campus gender related incidents in which the reconsideration review results in a decision to be re determined, if the applicant, victim, or respondent still disagrees, they must first go through the reconsideration procedure again before filing appeals or administrative remedy procedures. Please take note.
Explanation:
1. Handled in accordance with the resolution of the 8th meeting of the Campus Gender Incident Prevention Group of the 10th Gender Equity Education Committee of the Ministry held on May 11 2023 and the resolution of the 487th meeting of the Ministry Administrative Appeal Review Committee held on April 21 2023. This also replies to the Taichung City Government letter dated June 1 2023 Fu Shou Chiao Hsueh Tzu No 1120146706.
2. The Gender Equity Education Act was amended and promulgated on August 16 2023 by Presidential Order Hua Tsung Yi I Tzu No 11200069321. Article 37 Paragraph 1 and Paragraph 2 stipulate in summary: "(Paragraph 1) If the applicant, victim, or respondent disagrees with the results of the handling described in Paragraph 3 of the preceding article, they may submit a written reconsideration with reasons to the school or competent authority within 30 days from the day following receipt of the written notice. However, if the respondent is the principal, teacher, staff member, or worker, the applicant or victim may directly submit the reconsideration to the competent authority. (Paragraph 2) The reconsideration mentioned in the preceding paragraph is limited to one time only."
3. According to the resolutions of the aforementioned meetings, for the same campus gender incident case and the same subject matter, reconsideration is limited to one time. Regardless of whether the investigation procedure is reopened, as long as a decision is re determined, the reconsideration procedure must be conducted again before filing complaints, administrative appeals, or other remedy procedures.
